A concept that has been used by the European Court of Human Rights as the basis for assessing whether or not an interference with a qualified right is necessary in a democratic society. A qualified right is a right set out in the European Convention on Human Rights that will only be violated if the interference with it is not proportionate. An interference with a qualified right that is not proportionate to the legitimate aim being pursued will not be lawful.
